According to the CDC, falls and automobile accidents account for 72% of all brain injuries in the United States. Concussions resulting from accidents are common but often overlooked. This is because brain injuries such as concussions cannot always be identified on diagnostic testing such as scans and MRIs. If a brain injury is revealed on an MRI or CT scan, it is often seen only when the exam is performed a few days after the accident.
Once a concussion has healed, the injury victim may suffer from post-concussive syndrome. Some signs and symptoms of post-concussive syndrome may include one or more of the following:
- Trouble sleeping
- Memory loss
- Word recall/vocabulary difficulties
- Trouble concentrating
- Ringing in ears (tinnitus)
- Blurry vision
- Light sensitivity (photophobia)
- Noise sensitivity
- Crying spells / emotional lability
Unfortunately, there are no medications that have been adequately proven to effectively treat concussions and other traumatic brain injuries. The best treatment currently available includes psychological counseling and the passage of time. Those who experience memory problems can alleviate the effects of such symptoms by writing things down and calendaring upcoming events and appointments. Those who suffer from post-concussive syndrome must often rely upon their family and social support systems. In my practice, I have found that spouses and parents of brain-injured clients play an essential role in helping the victim during recovery.
Brain injuries pose special challenges in litigation because insurance companies often argue that the victim is exaggerating his or her symptoms. The insurance company and its lawyers may even go so far as to insist that the victim undergo an Independent Medical Examination conducted by a doctor that the insurance company has picked and paid for.
